1. Acceptance of these Terms

These Terms & Conditions (“Terms”) form a legally binding agreement between you and Mega Fortuna Teknoloji ve Yazılım Anonim Şirketi (“Testimo,” “Mega Fortuna,” “we,” “us,” or “our”) regarding your access to and use of the Testimo mobile application, testimo.megafortuna.co, and related services (collectively, the “Services”).

By creating an account, selecting an acceptance control, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

Adults only

You must be at least 18 years old and legally capable of entering into a binding agreement to use Testimo. By using the Services, you represent that you meet these requirements and are not prohibited from using the Services under applicable law.

Your account

• You may maintain only one account unless we expressly permit otherwise.
• You must provide accurate, current information and keep it updated.
• You are responsible for your login credentials and all activity under your account.
• You may not sell, transfer, lend, or allow another person to use your account.
• You must promptly tell us if you suspect unauthorized access.

Some parts of the Services may be accessible without an account, but full functionality may require registration, device permissions, and eligibility checks.

3. The Testimo service

Testimo is a game discovery and testing app for adults who enjoy mobile games. The Services may allow eligible users to browse available games, review structured missions, install third-party titles, complete gameplay checkpoints, track active progress, participate in available game-related surveys, and access available gift-card redemption options.

In Testimo, “test,” “testing,” “tester,” and “playtest” refer to trying listed games and progressing through their missions and gameplay checkpoints. Testimo is not a professional quality-assurance, bug-reporting, gameplay-recording, or developer-testing platform.

We may add, change, limit, suspend, or remove games, missions, checkpoints, surveys, features, or parts of the Services at any time. Availability may vary by user, device, account, operating system, location, and time.

4. Games, missions, checkpoints, and tracking

• Each listed game may have its own mission, checkpoints, eligibility criteria, and deadline.
• You are responsible for reviewing the mission information before starting and completing each requirement as displayed.
• Checkpoint paths differ by title and may change where necessary to correct errors, address partner changes, or protect the Services.
• Some games require separate installation and are governed by the developer’s own terms and privacy policy.
• Progress may depend on permissions, attribution technology, and information received from partners. Updates can be delayed, incomplete, or unavailable.
• We may review or withhold progress that cannot be verified or appears manipulated, duplicated, ineligible, or fraudulent.

Testimo does not guarantee that a particular game, mission, checkpoint, or deadline will remain available. Starting a mission does not guarantee completion, continued availability, eligibility for a survey, or access to a redemption option.

5. Surveys and feedback

Available surveys provide a guided way to share feedback. Survey eligibility and availability may vary by user, game, device, location, and time. You agree to provide honest responses and to follow the instructions displayed in each survey.

Unless explicitly stated in the relevant flow, Testimo does not claim that your survey responses will be delivered to or influence a particular game developer. Surveys may be operated by third parties and may be subject to additional terms or privacy notices.

If you submit feedback, ideas, or suggestions about Testimo, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, adapt, and incorporate that feedback without restriction or compensation, to the extent permitted by law.

6. Qualifying activity and available redemptions

Eligible users may be able to redeem qualifying activity through available gift-card options. Eligibility, availability, thresholds, processing times, expiration rules, and other conditions are governed by the terms presented in Testimo at the time of the relevant activity or redemption. Those specific terms form part of these Terms.

• In-app balances, points, or similar units are promotional loyalty units, not cash, deposits, property, or stored value.
• They have no value outside Testimo and cannot be sold, transferred, exchanged, or redeemed except through an option expressly made available by us.
• Gift-card options and merchants vary by country, account, and time and may be unavailable.
• We may require account, phone, device, or identity verification before processing a redemption.
• We may delay, deny, reverse, or cancel activity or redemption requests that are ineligible, duplicated, erroneous, manipulated, or associated with suspected fraud or a Terms violation.
• Third-party gift-card issuers may impose their own terms. We are not responsible for loss, theft, expiry, or merchant restrictions after valid delivery, except where required by law.

No game, mission, survey, qualifying activity, loyalty unit, or gift-card option is guaranteed. Nothing in the Services is an offer of employment, wages, investment, gambling, or a promise of income.

7. Acceptable use and prohibited conduct

You may use Testimo only for lawful, personal, non-commercial purposes. You must not:

• Create duplicate, false, borrowed, transferred, or automated accounts.
• Use bots, scripts, macros, automation, click farms, emulators, device farms, or unauthorized software.
• Manipulate device identifiers, attribution, gameplay events, location, IP address, mission progress, surveys, or redemption activity.
• Use a VPN, proxy, spoofing method, or other tool to misrepresent eligibility, country, device, or identity.
• Exploit errors, reverse engineer the Services, bypass security, scrape content, or interfere with normal operation.
• Submit false, misleading, abusive, unlawful, infringing, or harmful content or communications.
• Use the Services in a way that violates a game developer’s terms, applicable law, or another person’s rights.
• Attempt to sell, transfer, exchange, or fraudulently obtain loyalty units, gift cards, accounts, or access.

We may investigate suspected misuse and cooperate with partners or authorities where appropriate and permitted by law.

8. Third-party games and services

Testimo may display or link to games, app stores, surveys, websites, gift-card providers, identity providers, measurement services, or other third-party products. Those services are controlled by third parties, not Testimo. Your use of them may be governed by separate terms, licenses, fees, permissions, and privacy practices.

We do not own, operate, endorse, or guarantee third-party games or services merely because they appear in Testimo. To the extent permitted by law, we are not responsible for their content, availability, performance, security, purchases, or acts and omissions. Use appropriate judgment and review the third party’s terms before installing or using its service.

9. License and intellectual property

Subject to these Terms, we grant you a limited, revocable, personal, non-exclusive, non-transferable, and non-sublicensable license to access and use Testimo for personal, non-commercial purposes on a supported device.

Testimo, including its software, design, text, graphics, branding, databases, features, and other content, is owned by or licensed to Mega Fortuna and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, license, publicly display, reverse engineer, create derivative works from, or commercially exploit any part of the Services. Third-party games and marks remain the property of their owners.

10. Suspension, termination, and account deletion

You may stop using Testimo at any time and may request account deletion through an available in-app control or by contacting support. Deletion may permanently remove progress, balances, eligibility, and unredeemed activity, subject to legal retention requirements.

We may limit, suspend, or terminate access; invalidate activity; or disable redemptions if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, failed eligibility checks, or if continued access is no longer commercially or technically feasible. Where appropriate, we may provide notice and an opportunity to contact support.

Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, dispute provisions, and accrued rights—will continue to apply.

11. Disclaimers, limitation of liability, and indemnity

No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND FITNESS OF TRACKING DATA. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, A PARTICULAR GAME OR SURVEY, MISSION COMPLETION, PROGRESS RECOGNITION, OR ANY REDEMPTION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEGA FORTUNA AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, REVENUE, PROFITS, OPPORTUNITIES, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE CLAIM OR EUR 50. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mega Fortuna and its affiliates from claims, losses, liabilities, and expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.

12. Governing law and general terms

Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Disputes that the parties cannot resolve amicably will be arbitrated in Bursa, Türkiye under the Istanbul Arbitration Centre (ISTAC) rules in effect when the dispute is filed. There will be one arbitrator, and the arbitration language will be English, except where mandatory consumer law requires otherwise.

Changes

We may update these Terms to reflect changes to the Services, law, security, or our business. We will update the “Last updated” date and provide additional notice when required. Continued use after revised Terms take effect means you accept them; if you do not agree, stop using the Services.

General

These Terms and incorporated policies are the entire agreement regarding the Services. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. We may assign these Terms as part of a merger, reorganization, or sale; you may not assign them without our consent. Neither party is liable for delay caused by events beyond reasonable control.

Language and electronic communications

The English version controls if a translation conflicts with it. You agree that notices, agreements, and records may be provided electronically through the Services or by email, where permitted by law.
